Terms of Service

These Terms of Service ("Terms") govern your use of Ozzyapp, a personalized networking agentic application and related services operated by Soham Goswami, an individual developer in India ("we", "us", "our").

By creating an account, checking "I agree", or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Ozzyapp helps entrepreneurs and sales reps manage personal and professional relationships — contacts, follow-ups, notes, AI assistance, scheduling, and related features.

We may add, change, or remove features at any time. The Service is provided on an "as is" and "as available" basis.

You must be at least 16 years old (or the minimum age in your country) and able to form a binding contract. By using Ozzyapp, you represent that you meet these requirements.

• You must provide accurate registration information.
• You are responsible for keeping your password and device secure.
• You are responsible for all activity under your account.
• Notify us immediately at soham.sg@gmail.com if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms.

You own the content and contact data you upload or create in Ozzyapp ("Your Content").

You grant us a limited, worldwide, non-exclusive license to host, store, process, display, and transmit Your Content only to provide and improve the Service (including AI features you enable and backups).

You represent that:

• You have the right to store and process Your Content, including contact data about third parties
• Your use complies with applicable privacy laws (e.g. you have a lawful basis to hold others' contact details)
• Your Content does not violate any law or third-party rights

We are not responsible for Your Content. You are solely responsible for how you use CRM data (e.g. outreach, email, messaging).

You agree not to:

• Use the Service for spam, harassment, or unlawful outreach
• Upload malware or attempt to breach our systems
• Scrape, reverse engineer, or overload the Service without permission
• Use the Service to violate Google, LinkedIn, or other platform terms
• Impersonate others or create accounts for abusive purposes
• Resell or sublicense the Service without our written consent

We may investigate violations and cooperate with law enforcement.

Ozzyapp may connect to Google, LinkedIn, Google Calendar, and other services. Your use of those services is governed by their terms and privacy policies. We are not liable for third-party service outages, policy changes, or data handling by those providers.

You may disconnect integrations at any time; some features may stop working.

Ozzyapp offers AI-assisted features (on-device and, for premium users, cloud-based). You understand that:

• AI outputs may be incorrect, incomplete, or biased
• AI is not legal, financial, medical, or professional advice
• You are responsible for reviewing AI-generated text before sending it to contacts
• Cloud AI sends redacted context to third-party AI providers as described in our Privacy Policy

Use AI at your own discretion and risk.

Certain features require a paid subscription ("Premium").

• Payments are processed by Apple App Store or Google Play (or other platforms we specify).
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period via your app store account settings.
• Refunds are handled per Apple/Google refund policies, not directly by us.
• We may change pricing with notice where required by the app store or law.
• Premium access is tied to your account; sharing accounts is not permitted.

Free trials, if offered, convert to paid subscriptions unless cancelled before the trial ends.

Ozzyapp, its design, logos, and software (excluding Your Content) are owned by us or our licensors. You may not copy, modify, or distribute our software except as allowed by these Terms or app store rules.

Feedback you send us may be used without compensation.

Our Privacy Policy explains how we handle personal data. It is incorporated into these Terms by reference.

By you: You may stop using the Service and request account deletion at any time (see Privacy Policy).

By us: We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. We will try to give reasonable notice when practical.

Upon termination, your right to use the Service ends. Sections that by nature should survive (e.g. disclaimers, limitation of liability) will survive.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
• WE ARE NOT RESPONSIBLE FOR LOSSES FROM YOUR RELIANCE ON AI OUTPUTS, MISSED FOLLOW-UPS, OR SCHEDULING ERRORS.

Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the fullest extent allowed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100 (or equivalent in INR).

Some jurisdictions do not allow limitation of liability for personal injury or certain consumer rights; nothing here limits rights you cannot waive by law.

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your violation of these Terms, or your violation of others' rights or applicable law.

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Any dispute will be subject to the exclusive jurisdiction of the courts in Bengaluru, India, except where mandatory consumer protection laws in your country require otherwise.

If you are an EU/UK consumer, you may also have rights under local mandatory laws that cannot be overridden by this clause.

We may update these Terms. We will post updates at tryozzy.xyz/terms and update the "Last updated" date. Material changes may be notified in-app or by email. Continued use after changes constitutes acceptance.

If you downloaded Ozzyapp from the Apple App Store or Google Play, additional store terms apply. In case of conflict between these Terms and store-mandated terms, the store terms govern only to the extent required by that store.

Apple/Google are not parties to these Terms and have no obligation to provide support for the app.

• Entire agreement: These Terms + Privacy Policy = full agreement.
• Severability: If one clause is invalid, the rest remains in effect.
• No waiver: Failure to enforce a right is not a waiver.
• Assignment: You may not assign these Terms; we may assign them in connection with a merger or sale.
• Name changes: We may rebrand the Service (e.g. change Ozzyapp to another name). Your account and data will continue under the updated branding unless we notify you otherwise.
